127: How To Transfer House Ownership After Divorce

In this episode, we’re talking about, how do you go about changing the title on your home either during Divorce or after Divorce.

So what we find happens in many cases is that one of a few things will happen.

One of the parties will keep the house. The parties may keep the house in both their names and not refinance or a third option is that you sell the property.

In cases where you want to buy one of the party’s out, when you go to refinance the property, you can drop your spouse from the title of the home.

But what happens when you can’t refinance? And you’re just going to keep the existing loan on the property, how can you get the other party off of title?

What you have to do is do what’s called a quick claim deed. And you would file that with the county that you reside in.

And you can drop the other spouse off the property.

In this episode, we’re talking about California Divorce and specifically QDRO. This is Q-D-R-O. It stands for Qualified Domestic Relation Order.

And what this is a document that you may need if you have a pension or annuity or 401K.

Some of these companies require you if you’re going to divide up this properties. Let’s say its community property and you’re going through Divorce and you want to divide up a pension.

Then some of these pension companies 401Ks and annuities require you to divide it by a legal instrument called a QDRO.

In this episode, we will talk about summon changes or California divorce form FL-110.

This episode is just to let you know about the 2014 Form updates for Family Law for California divorce.

There are usually two updates a year and I just want to do a quick video on the form changes.

So far, for this first change of the year, there’s only one form that’s changed and this is the summons. This is FL-110 and looking at the form, it is much different as far as how it’s setup. I think the information there is exactly but it’s a lot easier to read and understand.

Specifically and I’m looking at the amount, what they’ve really done is they’ve really put an emphasis on the fact that on the back, on page 2 there are so much restraining orders that they need to be aware of.

118: Another Reason We Don’t Like California Summary Dissolutions

In this episode, we will discuss another reason why we don’t like California summary dissolution and what are your other way around it.

You know I’m not a big proponent of them and I’ll give you several alternatives to the summary dissolution option.

People think it’s a good option, I don’t think it is and here’s one more reason why I don’t like the summary dissolution.

This lady called me, she had filed a summary dissolution and she had it rejected by the court. The reason it was rejected by the court is because she had marked on there that she had been married for more than five years.
