When you do serve it however, when you file and serve it on the court, you also have to serve a copy to your spouse, so they know what’s going on, so they know it’s to be expected. You do have an opportunity. Say I’m paying spousal support, for instance and my spouse filed an FL 435 Spousal Support Earnings Assignment Order and I didn’t want that to be attached to my employer, a lot of people don’t like that.
It is what it is, but a lot of people don’t like to have it attached to their employer. You can object to that and it’s a form FL 450. You do have an opportunity to be heard if your spouse files an earnings assignment order for spousal support.
You’re supposed to file the 435, serve a copy on your employer with a blank FL 450, so they know they have an opportunity to respond and object to the earnings assignment order.
