San Fernando Divorce Court Self Help Center Alternative

Today, I wanted to provide this video for folks who are considering processing their own Divorce kind of talk to you about some of the uphill battles you’re going to face.

Explain a bit of the process and then kind of give you an alternative to using the San Fernando Divorce Self Help Center.

So family law is one of those original laws where you can complete your own case. If you’re going through an amicable case you can do all the paperwork on your own.

You can get the forms online. You can pay for online services. You can even go down to the San Fernando Divorce Court Self Help Center and get free assistance.

Now all of that is fine and well and it sounds great “Hey, you can get through your Divorce for free.”

But it doesn’t come without a bit of a complication. And I want to explain that to you so you know what you’re getting yourself into.

The Divorce Self Help Center in the San Fernando Courthouse is extremely busy. They usually can usually help between 10 and 15 people per day.

And you’re not going to get your entire Divorce case done in a day. You’re going to have to do this in steps.

So what happens is folks that are working routinely will miss several days of work going down to the courthouse, dealing with parking issues, dealing with waiting in long lines and then sometimes going down there and not even being assisted on that particular day.

So it could be quite lengthy and quite frustrating for folks.

Now I know this because number one years ago before I even got into this industry, I worked at the Self Help Centers as a volunteer.

And we’d see droves of people coming in each and everyday and we can’t just get everyone. And the help they get is usually minimal.

You’re being helped by volunteers who’d know or maybe had at least another day of experience more than you.

So that’s the unfortunate part there. But the main consideration is that it’s very time consuming to attempt to do your own Divorce case.

So here is what I tell folks. If you are unemployed and don’t have an income and you have all the time in the world to go down and spend days on there at the courthouse, then by all means it might be your best option.

San Fernando Court QDRO Preparation Service | Qualified Domestic Relations Order

Today, we’re talking about QDRO which is Qualified Domestic Relation Orders. And QDRO for folks who are going through Divorce or had their Divorce case processed at the San Fernando Courthouse.

So San Fernando QDRO is the name of this video.

And if you have a pension and you’re going through a Divorce or you’re going to get a Divorce or perhaps you’re using our service for your Divorce, if you have property and in that property is a pension 401K 403 (b), City County or State pension something like that in most cases if you’re going to divide that property, so, if you and your spouse are going to split that assets it needs to redone by what’s called QDRO.

That’s Q-D-R-O again Qualified Domestic Relations Order. The reason why I bring this up is that this is a service that we provide.

It does not have to be done by an attorney. Most people will tell you, you need to find a QDRO attorney but it’s not the case.

We are as a Legal Document Firm we do handle QDRO. We handle Divorce cases of course because QDRO falls under the umbrella of family law.

We also handle the preparation of Qualified Domestic Relation Orders.

So whether you’re using an attorney or you’ve done your own Divorce or you use our service, once your case is complete or somewhere during the Divorce process if you’re going to divide that pension if that’s the determination you may.

You’re going to have to do that by QDRO in most cases. So what I recommend you to do is call your 401K and let them know you’re going through Divorce and ask them, “Do I need to divide this pension by QDRO?”

If they say yes, you can ask them for a QDRO package. It’ll be helpful. We will need that when we go to complete your QDRO.

If you didn’t get it we can ask them for ourselves. But if you happened to speak to them to confirm you do need to have a Qualified Domestic Relation Order for that asset, you can ask them for the QDRO package you will need that to get your QDRO prep.

So I just want to let the folks know who have used our service or otherwise we do QDRO Preparation Service anywhere in California.

If you need that service we do it for a much lower rate than attorneys do it. For the QDRO can range anywhere as high as $2,000 to have an attorney prepare your QDRO.

And we charge a low flat fee much lower than that depending on the type of pension system it is.

California Divorce |Trial Setting Conference Now Requires Court Reporter Fee

I want to start off by saying I handle a lot of Divorce cases 40-50 Divorce cases every month. And these are Divorce cases where we handle the entire process from start to finish.

And because we file so many Divorce cases we’re usually the first to find out some new rule or new procedure with the Divorce courts.

And today we found out a new rule that just came up with. It’s not necessarily new. It’s just something that there’s been a change.

So one of the new rule that happened recently in Los Angeles County I’m sure it’s going to spread throughout the remaining counties in California, is the court you’re asking that parties who appear at hearings that they request, so, motions requested for order, order to show cost type hearings are they’re going to ask that you pay a court reporter fee.

This is the fee that the court uses to pay because court reporters are not part of the court system. They kind of run their own business in a way.

So now when you file a motion or ask for hearing you’re going to have to pay in addition to any court fees. Right now it’s a $30 court reporter fee.

Now this was a common practice recently for request for orders and things in that nature. The change now is for trial setting conferences.

So if your case is not moving forward usually what is recommended is you file a trial setting conference so it gets the court involved and they’ll start setting a series of hearings moving you towards a trial.

First hopefully you can come to an agreement at some point but if not you’ll end up a trial. But the trial setting conference was a routine request and it did not require a fee.

It was a no fee filing. And you need to appear in your hearing and it was part of your overall court filing fee.

Now and this was just today, we’re notified by a client who’s representing himself that because we set a trial setting conference request they received a notice and the mail says by the way when you appear you’ll be required to pay a $30 court reporter fee for the hearing.

So that’s the update today. If you file a trial setting conference, there is going to be a $30 fee now because the court houses and the court departments within the courthouses all either don’t pick up on the new policies right away or they handle there differently.

If you don’t asked to pay then you got lucky but you can anticipate that. We’re going to see this is a common practice across the courts in California asking for court reporter fee for trial setting conferences.
