Los Angeles Divorce | How To Complete Change Of Address

Today I want to talk to you about the change of address form that you need to file if you move during your divorce.

The clerk’s office has very specific rules or guidelines you could say in where they mail your documents. So, I want to talk to you about the change of address form and why it’s important you update your records with the court.

Let’s assume you file for divorce, you live in a location where, you file for divorce on your summons and petition and your case cover sheet that tells the court where you live. That’s the address the court’s going to have on record for you.

Not that they’re going to mail anything to you probably but if they were say for instance to set a hearing or something along those lines. They do that by mail, they don’t call you so you’re going to want to have your address correct with them.

The most important part is when you file your judgment. When you file your judgment, you’re going to file several documents. It’s twenty to twenty-five pages depending on your circumstances and one of those is a notice of entry of judgment form. It’s FL190 I believe.

That form is going to be mailed to you when you submit your final judgment, if the address on that document does not match the address that you initially filed with the court for that, if all your paperwork is correct, everything else is fine, they will reject your judgment because of a wrong address.

This is form MC-040 I believe, you can submit that change of address with your judgment just make sure you serve a copy or at least you give evidence of serving a copy on the other party but make sure you have that change of address completed.

Either before you submit your judgment or along with the submitted judgment so they know the address is correct and you notified the other party.

We wanted to make this easy for folks to locate because when people search for this type of information, they go to Google and they search and they may end up in a law firm website that may not be completely accurate.

So we thought, “Hey, let’s take them right to the California Court website so they can get the answers to their questions right here from the courts”.

Van Nuys Divorce Motions Now 90 Days Until Hearing

We just learned that Van Nuys divorce motions are taking 90 days to get a hearing.  This means from the time you file a Request For Order (RFO) it will be at least 90 days until you will see the judge.

(By the way, we can help you prepare a motion (request for order) if you are looking to file a motion or respond to one.)

This is bad news for those who are filing a motion with the court to modify child support or spousal support or need any type of orders for that matter.

We had previously written in the past on this topic where we reported that divorce motions were taking up to 60 days, which at the time was up from 45 days.

It appears the the service we can expect from the Los Angeles Divorce Courts are getting worse.  This is, by far, the longest time frames we have seen recently.  I spoke to our attorney service who files all our court documents everyday and they said that the Van Nuys divorce court is by far the worst when it comes to getting a hearing.

I don’t know if it is because it is October and the court has a lot of day of coming up that the court will be closed due to holidays and Judges out due to vacation or not, but we could only hope.  Because if this is a consistent issue, we will not likely see any improvements.

You have to keep this in mind when you are going to file a motion.  If you need an order right away, you are going to want to file a motion as soon as possible.  Today is September 30, 2013 and I was told by Van Nuys Court that they are already scheduling motions and hearing into January.

Let me give you a little reality on what this means.  Lets say you need to file a motion for child support or spousal support.  You are filing because your spouse won’t agree out of court to pay any support.

Obviously there is a need for support and you need money.  So you file your motion and you have to wait 90 days.  This is 90 days until the hearing only.  It is not like you are going to get a check from you spouse at the hearing!

Sometimes, after the hearing, the person who filed the motion will be asked to prepare an order after hearing that both parties would have to sign.  This process can add at least another month. Once you get that signed, you need to submit it to the court for the judge to sign.  Yes, you got it!  Another month indeed.

So now you are looking at almost 5 months before your request for spousal support or any order you request to take effect.

I Received A Notice Of Status Conference For My California Divorce

If you are in the divorce process in California and representing yourself, you may get a letter that is titled, “Notice Of Status Conference – Family Centered Case Resolution

This is a hearing that is set by the court and are used for specific purposes.  They are using this procedure in many cases to advise the parties that certain actions must be taken prior to a hearing.

The first such Notice Of Status Conference you may receive will be one which states that your divorce case is not complete.  You will receive this notice if you have not served your spouse the summons and petition within about 60 days from filing.

If you receive this notice, it will give you specific instruction on what you need to do prior to the hearing date.  In the example above, you would need to serve the summons and petition and complete your Declaration of Disclosure and file the Declaration Regarding Service of Declaration of Disclosure.  Both of these need to be filed with the court.

If you file the proof of service and Declaration of Disclosure, you will not need to go to the court date for the Status Conference.  The clerk will review your file on the date of your status conference and see that the appropriate documents were filed and take the hearing off calendar.

If you won’t be able to have the other party served by the time of the hearing you will most likely want to attend the hearing and advise the court why you have not done so and perhaps what problems you are running into.

The divorce courts have been taking a more proactive approach this year and setting status conferences to keep the cases moving through the court system.

Make sure to read any Notice of Status Conference you receive and make sure you comply with the courts requests.
