How To Get Temporary Orders Chatsworth Divorce Court

How To Get Temporary Orders Chatsworth Divorce Court

Today, we’re talking to the folks in Chatsworth who are going to be filing in the Chatsworth Courthouse.

As you may know they recently moved the San Fernando Court Family Law to Chatsworth.

So if you’re going through a Divorce and you’re at the Chatsworth Courthouse when you go through a divorce sometimes you need to get some temporary orders in place.

And temporary orders don’t come right away.

Meaning when you file for divorce you file the petition and that’s it you serve your spouse, you don’t have a court date even if your spouse responds you still don’t have a court date.

And people wait thinking that the courts are going to send a court date but they’re not. You have to purposely ask for a court date.

Now if you are filing for divorce and you need to get some temporary orders for let’s say spousal support or child support or custody orders you need to file a motion with the court.

It’s called a Request For Order or RFO. That is a service we provide if you’re using us for your divorce we obviously recommend this if we see that you need to get some temporary orders in place.

If you’re having some issues between by the time that your divorce is finalized.

Otherwise, if you’re not using our service feel free to contact us if you’ve filed your own case and you start the case you need assistance and you need to get some temporary orders we can file a motion on your behalf which entails drafting the motion declaration, explain to the court exactly what it is you’re asking for and why should the court should grant what you’re asking for.

The drafting of motion itself, the Request For Order itself, we’ll take it down to the Chatsworth Courthouse.

We’ll file it. We’ll get you a court date. And if there are custody issues we’ll also have to get you a mediation date.

And then we’ll also take care of serving your spouse. And all you have to do is appear at the hearing along with your spouse at that court date and the judge will ask a few questions or read your declaration.

They’ll read your spouses response and the judge will make temporary orders which will stand until what they say a future order of the court or tell your final judgment is entered in the case.

So I hope that was helpful. If you need assistance getting temporary orders or interim orders as they’re known please give us a call.

We’ll be happy to help you file your motion and get your court date and get the temporary orders you need before your Divorce case finishes in Chatsworth.

Feel free to visit our website at Divorce661.com or give me a phone call for a free consultation at 661-281-0266.

Chatsworth Divorce | What Forms Do You Need To File

Chatsworth Divorce | What Forms Do You Need To File

Today, we’re talking to the folks who are filing their Divorce in the Chatsworth Courthouse.

And I wanted to just let you know the first steps to they need to do to get your Divorce case filed to get started.

So the very first thing you’re going to need to do is there is simply three forms and sometimes four forms you need to fill out and prepare to take to the court to get those file.

That’s all the court needs.

So number one, the petition. Number two the summons.

Number three is the jurisdictional form that’ll let the courts know where you live and make sure you’re filing in the right court.

And that’s it. If you have children there’s one more form called the UCCJEA.

Now the reason I bring this up is a lot of folks when they’re calling to utilize our service.

They thought they have all their agreements in place and all the property and everything figured out.

That’s not the case. To file your divorce case you need four forms.

It’s mostly broiler plate information. Meaning it’s nothing about any decisions you need to make.

You don’t need to have any idea of your property or what you want to do with your kids or child support or spousal support or any of that figured out.

It’s just broiler plate where you live, how many children you have and a basic idea as far as custody if you want to have legal, joint legal or joint physical or whatever but there’s no specific order at this time.

The benefit to filing only these initial form three or four documents is that you can get it filed, get the case number issued and then you can serve your spouse and as you know that’s going to start the clock on the sixth month cooling off period the California has before your Divorce can be finalized.

In an alternative if you wait to get all your agreements in place, just note, your Divorce case hasn’t started and you’re ultimately delaying how long it’ll take before your Divorce can be finished.

Is Child Support Tax Deductible California Divorce

Is Child Support Tax Deductible California Divorce

We’re providing affordable way to get through your Divorce case. We are a Full Service.

We take care of the entire divorce from start to finish. All the paperwork, we’ll deal with the courts for you the whole shot.

I just want to kind of get that all the way.

Today, we’re talking about alimony and spousal support and we’re talking about taxes specifically related to spousal support and child support in California.

And we’re referencing the State of California Franchise Tax Board the publication they put out regarding this.

So we’re not giving legal advices. I just want to make sure that’s clear.

The question we’re answering today based of the publication is can I deduct child support payments?

Now well I think this is a fairly commonly understood question. We did want to get this out on video.

So directly from the State of California Franchise Tax Board, the question is, ‘Can I deduct child support payments?’

No. It starts with no, you cannot. It says here ‘Child support is not considered alimony. If your Divorce Decree or other written instrument or agreement calls for alimony and child support any paid less than the total required the payments applied first to child support any remaining amount is then considered alimony.’

Okay, so, first off no the Franchise Tax Board says child support you cannot deduct child support payments that you pay.

You cannot deduct that. You can only deduct alimony payments.

And you can look for the videos we’ve recorded regarding the alimony payments and how the Franchise Tax Board addresses those as well as Family Support as well.

So the simple answer no is child support payments are not considered to be something that you can deduct from you taxes if you’re paying spousal support and child support, the spousal support portion is and if it is considered family support based on this last statement here about the payments applied first to child support is interesting.

I think I might do another video right after this one regarding that because what this is saying if you have a family support order and the family support order is let’s say $500 a month and it specifically says 400 of that is child support only the difference only the $100 could be determined as could be tax deductible that alimony portion of the Family Support.

So I think I’ll do a separate video on that as well.

Feel free to give me a phone call for a free phone consultation.

Our number here is 661-281-0266, or, simply go to our website at Divorce661.com for more information.

Woodland Hills Divorce Mediation | Divorce Mediation Woodland Hills

Woodland Hills Divorce Mediation | Divorce Mediation Woodland Hills

We’re talking about our Woodland Hills Mediation Service.

We’re actually talking just about Mediation in general today to let folks know that if you’re going through a divorce you have options.

You can hire an attorney if you need legal advice or representation in court of course.

Number two, is you can figure out things on your own. We handle about 50 cases a month right now.

And the majority of our clients are able to figure out their disposition of their assets and debts and custody arrangements and alimony and child support, of course, with our assistance and get through with the entire divorce without any third party services.

Sometimes we need to bring in a Mediation Service to help them come to an agreement whether that means there’s a single issue.

Perhaps the amount of child support or a custody arrangements or maybe there’s multiple issues depending on what you need, depending on how many issues you have.

It depends on what type of mediation you’re going to need. Meaning you may just need a single mediator to sit between you and help with communication in coming to agreements.

You may need co-mediation where you have two attorneys or maybe an attorney out there to sit in a room with you helping you guys work through a multitude of issues.

Of course, the cost varies depending on what type of mediation you need.

But what we want to get across today in this video is that if you are going to go to a divorce the first thing you need to do is start your divorce by filing the paperwork.

And that’s where we come in. We can help you fill out the forms. We go down the court for you.

We’ll take care of filing, serving, listing all the assets and debts because the truth is you can’t start mediation or you can’t really start discussing how you’re going to divide up your property until you’ve completed the disclosure step of the divorce process which really requires you to lay out all your assets and debts of the marriage.

You guys can sit down and say ‘Okay, what do we have? How are we going to divide this up? What our alimony payments going to be? What’s going to be fair and equitable to both parties?’

So if you’re going through a divorce in Woodland Hills give me a call.

I’d love to help you out with your divorce case.

We do handle of all California but I want to get a video out to the folks in Woodland Hills area.

My name is Tim Blankenship. I’ll be happy to provide you a free phone consultation at 661-281-0266 or you can just go to our website for more information at Divorce661.com.

California Divorce What Is Family Support

California Divorce What Is Family Support

Today, we’re talking about family support.

So when you get divorce there has to be alimony, spousal support whatever you want to call it but there’s also this thing called family support.

Now it doesn’t come up too often but we just had a client of ours asking about it.

So I want to get the video, I realized we hadn’t discuss the family support issues.

Sorry my screen just went away there. I just want to keep rolling now.

So family support. And I’m reading this right off the Franchise Tax Board Publication that put out information basically frequently asked questions about alimony.

And make sure you watch all the series of videos. We’re going to do about 12 or so videos about on spousal support and how it’s treated tax wise.

So it’s a very good series of videos here. This question says, ‘I get family support from my former spouse. Is that considered taxable income?’

And the answers says here, ‘If the Divorce Decree or Separation instrument provide for family support but no amount of the family support is designated as child support then the entire payment is considered alimony.’

So let me just kind of put that in plain English. A typical spousal support or typical let’s say judgment or marital settlement agreements in California, if you  have support and child support included in your Divorce it will break that up separately.

Let’s say X amount as for spousal support, X amount for child support. In a family support order it is just family support.

So it could be just a fix amount for family support not specifying how much is alimony, how much is child support.

Now in area this can get kind of complicated but basically they says if it says you’re paying a thousand dollars for family support and it doesn’t say of these a certain amount is child support, then they’re saying that the entire amount is considered alimony.

And the reason that’s important to know is because alimony as per the Franchise Tax Board is a taxable event.

So the payor spouse can deduct that amount from spousal support whereas for family support and it could be treated as alimony and the person receiving it would claim that income.

So we’re doing a lot of videos about right now in these series of alimony and spousal support in California and how it’s affected from a tax perspective.

We’re taking this information right off the Franchise Tax Board for the State of California website.

We’re not tax advisers or tax attorneys or even family law attorney so please don’t take any of these as legal advice.

But do feel free to call us if you need assistance with your Divorce in California.

I’ll be happy to provide you a free phone consultation at 661-281-0266 or simply go to Divorce661.com for more information.
