When it comes to divorce, California is a no-fault state, which means the courts don’t care whose fault it is or why you are getting a divorce in California.  So in this video we talk about whether fault matters in divorce in California because some interesting topics come up such as, if your spouse is the reason for the divorce ( say they cheated, etc.) do you still have to pay them spousal support?  Watch this video for more information about our no fault State of California.

Today, we’re talking about here in California Divorce cases it doesn’t matter whose fault it is when you get Divorce knowing that California is a No Fault State.

So I just want to break that down a little bit. And then tell you about some of the things that we’ve seen with some of our clients.

And you can decide if what’s fair or if you’ll agree with how the law works. So in California it is a No Fault State. The honest truth is the courts do not care why you’re getting a Divorce.

They don’t ask. No one will ask you. No one will care.

The only ones that cares, is you, and perhaps your family and your spouse. No one cares why you’re getting Divorce meaning the reasons behind it.

It doesn’t matter if it’s your fault or your spouse’s fault or a combination. It doesn’t matter when you file for Divorce in California.

There’s a single box that you mark. And the box you’re going to mark is irreconcilable differences. That’s all the court asks you to provide as far as information regarding why you want to get a Divorce.

Now some will think that the laws are not fair when it comes to dividing property if someone is at fault. I’m not saying that it isn’t always one persons fault.

Usually you can attribute the Divorce to probably one of you. If not both but probably one of you can point the finger at each other as far as the reasons for Divorce.

And therefore there could be some upset when someone asks for a Divorce when perhaps you thought everything was fine up to that point.

And I want to give you an example as it pertains to dividing up your property.

So I had clients who came in and we worked with amicable cases for the most part.

And we’re dealing with both couples and sitting down at my desk here. And we’re kind of rushing out the property and how things are going to be divided up.

And in this particular case the wife was the one that asked for the Divorce.

And honestly she said, “I didn’t have—there’s no real reason I’m filing for Divorce other than I just want a Divorce. And move on with my life. And start a new chapter.”

Probably she had fallen out of love, I would imagine, maybe she found someone else who she wants to live her life with or what have you and this was a long term marriage.

So the couple as far as their property is concerned they had built up considerable decent amount of wealth. They had a home that was paid off.

They had several assets 401K’s and they were in good shape. Had they continued on their marriage, they would have been in great shape for retirement.

So what happened in going through Divorce is they had to divide their property.

And this could become a nightmare as far as where you–how you were set up financially dividing everything 50-50 which is what they ended up doing.

He had to take out a mortgage on the house to cash her out on that property. They had to split all of their 401K’s down the middle.

And that could be devastating. He was devastated that he said, “Look Tim we’ve built up this family. We are in good shape for retirement.”

And he asked too. “I really have to get half? She’s the one causing the Divorce. She’s the one that’s asking for Divorce. Why do I have to split all my assets with her?”

Unfortunately, that’s just the law and it is sad. I mean they’ve been married I think 20, 25 years maybe getting ready or at least talking about retirement.

They’re in great shape financially. And at the end of the day they went through the case together.

And he said, “Well, there’s really nothing I can do about it.” which is true and so they decided not to fight it out just put their assets.

And I just want to comment on this because it’s not –you put it in some of the bad or worst financial, well they were in good financial shape.

So I would say that put them in a lesser good financial shape, if I could put it in those words because where they were financially with their assets and paid off a home was in a great position.

Now with the Divorce they’re going to have half of what they had together. And now there’s mortgage involved because they had cash out the house and all that.

So unfortunately, the point of the story was when you’re going through a Divorce it doesn’t matter whose fault it is.

It doesn’t mean if one spouse is responsible if you can point the finger at being the reason for the Divorce, they don’t get any –it doesn’t mean you get to keep the property or anything like that.

It doesn’t matter what the reason or who’s the cause of the Divorce. And this also goes for spousal support. That’s through another scenario actually.

Let’s say that one spouse is working the entire relationship. And the spouse, let’s just say in this case the wife, not to be sexist or anything but just to so we can determine who the parties are here.

So the man worked has worked for 20 to 30 years and continues to work while the wife stays at home mom, took care of the kids and so forth.

And now they’re divorcing. Well guess what? There’s going to be spousal support that needs to be paid in most cases.

And even if it is the wife’s fault for Divorce maybe she just decided to move on like the previous scenario then, guess what? She’s going to get spousal support.

And it’s going to – there are two different tough processes from the wife she feels as ‘well I was the one who allowed you to work and helped you through your career. And that’s why you have the job and career that you have.’

The other perspective is the man where he says and I say this because I talked to people everyday about their Divorce. That’s why I’m sharing these stories with you.

The man says ‘Well if I work my entire career and she just sat home and took care of the kids. And I was the one who made all the income and now after providing for my wife all these years 20, 30 years I still have to pay her money?’

And so you can see it’s just an interesting different perspective on how and what goes through the minds of each of the spouses when it comes to property and spousal support when going through a Divorce in California.

Today, we’re going to talk a little bit more about consultations. So we’re talking about going on a consultation with an attorney.

This isn’t applied to us but we are here about giving information and providing information so people have the information they need before getting involved with an attorney because it’s kind of one of my pet peeves if you will.

So we’re talking about going on a consultation with a Divorce attorney and specifically if you should pay for your consultation or if you should find an attorney that’s offering free consultations.

So first of, I have my own opinion on this. And I tell people this every day who may want to talk to an attorney and are maybe looking for a more affordable way of getting that consultation through a free consultation.

But I want to share my opinion with you on this issue.

So if you’re going to go on a consultation for Divorce with an attorney, I feel personally that you should pay for your consultation and here is why.

And basically I’m going to talk to you about the differences so you can see the differences here.

So when you pay for your consultation with the Divorce attorney you are buying their time. You’re paying for their time.

So they are going be there for you. They’re going to answer your questions.

They know that their time is being compensated for their time. So they’re going to spend that hour, the consultations are usually an hour.

They’re going to spend that time answering the legal questions that you have.

Now going in to these consultations we recommend that you have a list of questions that you want to ask before you arrive because people often tell me that they went—the hour they went by very fast.

And they forgot to ask certain questions but the time is up. You can’t go back. You’re going to have to pay for another consultation.

Now here’s why say pay for their time in the consultation. There are ways and I’ll explain in this video there are ways that you can get a free consultation from an attorney.

First of all, some of them are just flat out offer. They offer free 30 minutes.

Generally, it’s a reduced time frame consultation or might not even be in an office consultation.

It may just be 15 or 30 minute phone consultation to discuss your case. But the problem with the free consultation is they don’t give you the legal advice in most cases you’re looking for.

What they’re trying to do by offering a free consultation is trying to sell you more on their services and what they can do for you as opposed to giving you a legal advice which you would get more of if you paid for their time with the paid consultation for your Divorce.

Another way to get a free consultation from an attorney if you’re going to go that route because, honestly if you flat out and don’t have the money then a free consultation is better than no consultation.

In that case what I recommend you do is go to your local County Bar Association. So what you want to do is Google.

So we’re in Los Angeles County, Los Angeles County Bar Association.

If you do that for any county that you’re in there’s going to be a Bar Association that you’ll find.

The Bar Associations are group where the attorneys are members of, but they’re also are an attorney referral network.

So you can call them up, say, “I’m looking for an attorney for Divorce. I live in…” this particular city and they will refer you to an attorney.

And generally the agreement they have with these attorneys is if they refer them to someone for a referral that they’ll offer a free consultation.

That’s how it is in Los Angeles County. If you call them up, the Los Angeles County Bar Association “Hey, I need an attorney for Divorce. I need a consultation.”

They will pick one in at random. They will give you information to the law firm. The law firm will contact you directly to set up the consultation.

And generally it’s a free consultation.

So that’s the best the easiest way to get a consultation for free is to go by that route. But again, I stand by my belief that if you really want to get valuable, legal information you should pay for their time.

And the good news is even if it’s a $300 or $400 an hour attorney, they generally have fix rates for their consultation.

It’s not based on their regular hourly rate. It’s based on flat fee consultations.

You’re going to want to make sure to ask how much it is going to be for the consultation.

Now we talked about Divorce a lot. I mean that is in every topic, every video, and every podcast we record. We talked about Divorce a lot.

But in this article, I want to talk about an interesting article I came across that was talking about some of the key traits and qualities you should have and your spouse should have to have a successful marriage or you should look for in a future spouse to have a successful marriage.

Now I want to give credit on what editors do. I found this article interesting enough.

I found a —I’ve read an article today talking about how many women are becoming millionaires because of Divorce.

So they’re getting half of their spouses’ assets, either by being bought out or in business or something like that.

And it got me to thinking about just first in California for United States as far as Divorce is concerned I was looking for traits of millionaires because that’s what this article was talking about.

And I came across an article that’s talking about certain traits in millionaire couples. And I’m not going to talk about the millionaire aspect of it.

But I think these traits and key qualities are good for anybody regardless of your level of wealth.

Now the article came from thompsonlaw.ca if you want to read the article on that website.

But I’m just going to pull out from it these key points that the spouse’s found in each of their spouse and what is made for a lasting relationships.

And just kind of the off topic the article was talking about millionaires in general. And some of the traits and qualities they saw in each other.

And I want to share that with you. But they’re also talking about that millionaires lived longer. I’m sorry they don’t live longer. They have longer marriages.

And they wanted to see, okay, if there’s longer marriages, is it just the money or is there a certain traits and qualities that they looked in their spouse. And is that the reason for the long term marriage.

So that’s why I want to bring this up because it works for millionaires it should probably work for the rest of us as well.

So in this article it says both spouses identify and credit each other as having certain important trait. Of these the most important they both agree on and identify in each other are unselfish, caring, forgiving, patient, understanding, discipline and virtuous.

Now of course, these are very impactful words. And it just goes without saying that if both parties are focusing or have these traits of being unselfish, caring, forgiving, patient, understanding, discipline and virtuous, I think you would agree that your marriage should last.

Or at least have the better than not chance of lasting, if we’re doing those, because as I’ve been married now for a long time.

I do have a lot of those traits. But I know that there are times when I’m not or when I’m definitely being selfish, sometimes not caring. Forgiving? I’m easily—I easily forgive.

My wife does not—Man! She can hang on to some anger for a given amount of time. I think women have that all going for them.

I’m patient. I’m getting more patient as life goes on. Understanding, I’m pretty good in that. Discipline, yes. Virtuous, yes!

So those were the main traits that both spouses identify with each other in having a long term marriage or successful marriage.

And of course you know if you do those, if you have those traits you are going to probably have better than not chance of having a long term happy marriage.

Now let’s talk about the key qualities says nearly all spouses see five key qualities in their spouses and agree on the importance of these qualities in contributing to a successful and lasting marriage.

So you have the traits. And then you have these key qualities in their spouses. And it says—here they are. Honest, responsible, loving, capable and supportive and in that order, so honest, responsible, loving, capable and supportive.

So if you take the five key qualities and I think it was seven traits these are very powerful traits and qualities if one were to have them all and was able to carry through with those all the time and both spouses would did that which in this case that was the case, then you can see that, that would definitely make a longer lasting successful marriage.

So if we work on those areas, knowing that these have been identified in this report that if you don’t have these qualities perhaps work on having these qualities and see if you can either turn around your marriage or start making it a more successful one if you’re already in good shape.

One of the things I wanted to point out is this goes back to the millionaire mindset. I guess you would say, it says millionaire husbands found their wives physically attractive when they first met them but were drawn to them by much more.

So and then it says that non-millionaires the article goes on that non-millionaires look at mostly how attracted they are to their wife or their future wife and not much more.

Just the attractiveness and throw out intelligence, throw out any other attribute that they may have.

So I think if that is definitely a dividing factor. So they found their wives physically attractive when they first met them but were drawn to them much more.

They were attracted by their future wives intelligence, sincerity, cheerfulness, reliability and affection in nature.

And it says here, this contrast with non-millionaire men who considered physical attractiveness as the overwhelming basis of attraction early in their relationships.

So I think this was a great article. I know we talked about Divorce a lot, so, I want to talk about maintain your marriage because as you know we are not here in support of Divorce.

But for me, I’m still married and I’m just going to make sure that I maybe just pay attention, maybe write these traits and qualities down and we’ll make sure to work on them on a daily basis because I’d like to maintain my marriage as well.
