184: Divorce Mediation Is Not For Everyone

In this episode, we will discuss divorce mediation and how it is not for everyone.

The myth was mediation is always the best option for every divorcing couple.

So is Divorce Mediation is the best option for everyone?

No. In my earlier days and when I was training and going to school, I just thought this is the answer to world peace.

And everybody should just sit down and if you’re a good enough mediator, you can get an agreement out of anybody.

That is not the case. Now there are issues especially in Divorce that you do not want to mediate. You shouldn’t mediate.

It’s not appropriate for mediation. It’s something and that’s why the courts are there and that’s why good attorneys are there and that’s why the judge is there to protect people from these kinds of things.

And that’s domestic violence and any kind of child abuse going on and any kind of serious criminally activity with money on either side.

Those kinds of things cannot be mediated.

I don’t know if we touched on the importance of changing beneficiaries after the Divorce has finalized because we’ve all heard the whole stories not only with health life insurance.

I’m sure that if you’re Divorce that wasn’t the intention. Because the important thing to know is, when it comes to you and let me know if this is correct or not.

When it comes to your Divorce judgment your Divorce Decree if you will, if you said, you’re keeping your life insurance policy or these investments, and you die and you haven’t changed your beneficiaries, that beneficiaries will over-way the ruling of the court.

California Divorce – Is Divorce Mediation A Possibility

Today, I just want to tell and talk about a story of a client that came in.

I’m going to start doing this more often. We have client come in very upset.

The other spouse had closed all the accounts. They got into things that weren’t going so well.

Things are going downhill in their relationship. They started talking about the possibility of Divorce.

And one day the spouse one of the spouses, I just want to try and keep this so no one knows who we’re talking about.

But one of the spouses and this happens so many times, close the accounts, withdraw all the money at the accounts, changed the accounts so the direct deposit will go in to different account and removed any access to money from the other spouse.

So when this person first came in to our office for assistance, of course, they were very upset.

And there is certain thing that we suggest that she’ll do. They had three young children.

And one of the worst things we think can happen is when the parties go out and get attorneys and then they want to fight and spend all their money.

In this particular case while that party come in to us was very upset we explain the process and procedure of using our service to get her through their Divorce case and using the potential of Mediation because this can go one of two ways.

You can try and get through this yourself. You can go out and hire attorneys and spend a bunch of monies fighting over things or you could come to your senses sooner versus later and not blow all the money on Divorce and Divorce Attorneys and use Mediation.

So what we did instead of filing motions which is if they went to an attorney what would have happened filed motions for child support and child custody child visitation, spousal support the whole thing.

And that’s what we initially we’re going to do.

But then I took a step back and said, ‘Look you have three young children. There’s not a lot of money that should to go around, to spend on attorneys and so forth. Let’s take your step back. Let’s give this a few days. Let’s see if the other party will be reasonable. And that we can get you guys into some sort of agreement whether that’d be you guys sitting down at the kitchen table and working this out.

Or let’s get a Mediation team involved right away because obviously there’s a lot of emotional charge here and they need to get someone in the room to sit with them to help them communicate and get through this.’

So we’re going to do that as our first attempt. We’re going to see if we can get them into Mediation and get them through this.

Everyone who ends up better off, it will be less costly. Their children are going to be better off.

Just keep in mind when you have kids you maybe able to get a divorce but the portion of your relationship regarding parenting is going to exist potentially forever.

So you’re going to be seeing that person all the time.

So that said take a step back if you know I work for a law firm for many years and we saw people coming and spend $20,000 per month each end.

You know staying mad at each other and fighting over everything. And guess when they would settle?–when they ran out of money.

So the point of the story is, don’t let that happen to you. Try and work it out.

Try and use Mediation or some other types of service. Of course, sometimes attorneys are going to be your only option.

But just know that that’s going to be come in a very high expense.

In this episode, we will talk about beneficiary options for children during divorce in California.

As it pertains to Life Insurance and with having young children and making them the beneficiaries, going through a Divorce, what are some of the options folks have?

Can they assign other beneficiaries or how does that work and how does that ultimately get transferred?

changing beneficiaries for some is very easy. And it’s usually one page form. You say, ‘Now I want my brother to be the beneficiary.’ and you sign it.

It’s that simple.

So what we usually encourage people to do is that they’re not going to go down the road of some sort of trust, is to name a family member an adult family member who’d be the one that they would expect to handle their affairs when something happened to them.

And so that maybe, I mean it’s still be a parent depending on how old you are. It maybe a brother or sister or somebody or an extremely close friend but that’s your choice to make.

Divorce661 Review – California Divorce Completed In 3 Days

Today, I wanted to talk about a nice review that we received from one of our clients and just talk about some of the issues she had once she came to us for help.

So this person had been trying to get through their Divorce for three years. She had no attorney.

She tried to do things herself. And after three years her paperwork was still getting rejected by the court.

Had multiple problems and by all investigation it appeared she had done many things correctly.

In this case she came to ask for assistance and she said, ‘Tim I’ve just had it. I need to get this done before the end of the year.’

And I had her send us all her paperwork. She mailed out everything to us.

I went through her entire case and did a judgment review, looked everything, fix every little error, every little thing that was wrong with it.

We cleaned it up, fix it. We got new signatures, prepared an entire new judgment.

Submitted her case three days later and she just contacted us yesterday because the courts notify the parties by mail when their judgments entered and she was so excited that her case was finally done.

We wrapped her case up in three days on our end and it took less than three weeks for the court to review it and approved it.

And I just took a little bit of going through the case and making sure everything was good to go.

And communicating with the court clerk who had rejected the case multiple times and noting their error and their misunderstanding of what was wrong of the paperwork and clarifying for them.

And that’s what made this go through. So I guess the point of story is that we’ve very glad that we’re able to help our clients.
