Today, we’re answering the question about spousal support, child support and family support and some of the common mistakes made by tax payers.

Now we’re getting this information right from the State of California Franchise Tax Board.

And we’ve already done a couple video where we discussed family support, child support and spousal support separately.

But I wanted to read to you what the State of California Franchise Tax Board says some people are making as far as mistakes related to support with that family support, child support and spousal support.

So it says many tax payors mistakenly consider all payments made to their former spouses as deductible alimony payments.

For example, tax payers frequently include none deductible child support payments as alimony deductions.

On the other hand many alimony recipients do not consider the payments from their former spouses as taxable income and failed to report them.

Some recipients make the common mistake of not reporting income designed as Family Support by the Divorce Decree.

This type of support is considered alimony income in most cases.

Now so basically what that means is and we can kind of recap the three previous videos child support is not tax deductible according to the Franchise Tax Board.

Spousal support is tax deductible and thus reportable income to the spouse receiving income.

So that’s essentially the three mistakes that folks are making. And you could see that, that would have it on your taxes if you are not deducting your spousal support payment you’re making, if you’re not reporting the spousal support payments you are receiving or you’re deducting or claiming the income of child support which you shouldn’t do.

So I hope that answers the question of the common mistakes made by tax payers regarding to support payments in California.

Today, we’re talking to the folks in Chatsworth who are going to be filing in the Chatsworth Courthouse.

As you may know they recently moved the San Fernando Court Family Law to Chatsworth.

So if you’re going through a Divorce and you’re at the Chatsworth Courthouse when you go through a divorce sometimes you need to get some temporary orders in place.

And temporary orders don’t come right away.

Meaning when you file for divorce you file the petition and that’s it you serve your spouse, you don’t have a court date even if your spouse responds you still don’t have a court date.

And people wait thinking that the courts are going to send a court date but they’re not. You have to purposely ask for a court date.

Now if you are filing for divorce and you need to get some temporary orders for let’s say spousal support or child support or custody orders you need to file a motion with the court.

It’s called a Request For Order or RFO. That is a service we provide if you’re using us for your divorce we obviously recommend this if we see that you need to get some temporary orders in place.

If you’re having some issues between by the time that your divorce is finalized.

Today, we’re talking to the folks who are filing their Divorce in the Chatsworth Courthouse.

And I wanted to just let you know the first steps to they need to do to get your Divorce case filed to get started.

So the very first thing you’re going to need to do is there is simply three forms and sometimes four forms you need to fill out and prepare to take to the court to get those file.

That’s all the court needs.

So number one, the petition. Number two the summons.

Number three is the jurisdictional form that’ll let the courts know where you live and make sure you’re filing in the right court.

And that’s it. If you have children there’s one more form called the UCCJEA.

Now the reason I bring this up is a lot of folks when they’re calling to utilize our service.

They thought they have all their agreements in place and all the property and everything figured out.

That’s not the case. To file your divorce case you need four forms.

It’s mostly broiler plate information. Meaning it’s nothing about any decisions you need to make.

You don’t need to have any idea of your property or what you want to do with your kids or child support or spousal support or any of that figured out.

It’s just broiler plate where you live, how many children you have and a basic idea as far as custody if you want to have legal, joint legal or joint physical or whatever but there’s no specific order at this time.

The benefit to filing only these initial form three or four documents is that you can get it filed, get the case number issued and then you can serve your spouse and as you know that’s going to start the clock on the sixth month cooling off period the California has before your Divorce can be finalized.

In an alternative if you wait to get all your agreements in place, just note, your Divorce case hasn’t started and you’re ultimately delaying how long it’ll take before your Divorce can be finished.

I just want to kind of get that all the way.

Today, we’re talking about alimony and spousal support and we’re talking about taxes specifically related to spousal support and child support in California.

And we’re referencing the State of California Franchise Tax Board the publication they put out regarding this.

So we’re not giving legal advices. I just want to make sure that’s clear.

The question we’re answering today based of the publication is can I deduct child support payments?

Now well I think this is a fairly commonly understood question. We did want to get this out on video.

So directly from the State of California Franchise Tax Board, the question is, ‘Can I deduct child support payments?’

No. It starts with no, you cannot. It says here ‘Child support is not considered alimony. If your Divorce Decree or other written instrument or agreement calls for alimony and child support any paid less than the total required the payments applied first to child support any remaining amount is then considered alimony.’

Okay, so, first off no the Franchise Tax Board says child support you cannot deduct child support payments that you pay.

You cannot deduct that. You can only deduct alimony payments.

And you can look for the videos we’ve recorded regarding the alimony payments and how the Franchise Tax Board addresses those as well as Family Support as well.

So the simple answer no is child support payments are not considered to be something that you can deduct from you taxes if you’re paying spousal support and child support, the spousal support portion is and if it is considered family support based on this last statement here about the payments applied first to child support is interesting.

I think I might do another video right after this one regarding that because what this is saying if you have a family support order and the family support order is let’s say $500 a month and it specifically says 400 of that is child support only the difference only the $100 could be determined as could be tax deductible that alimony portion of the Family Support.

So I think I’ll do a separate video on that as well.
