In this interview, we talk to Lisa Scholz who shares here background with California divorce mediation.

Tim: Today we’re here with Lisa Scholz who is a mediator.

And I want to get these videos out to folks with there’s a big misunderstanding about what mediators do when it’s in regards to family law.

So we wanted to get some information out there so we can kind of pull the curtain back on what mediation is in regards to and how it works with Family Law and Divorces specifically.

So Lisa Scholz is a Mediator/Divorce Coach. Why don’t you tell us a little bit about that does? And what mediation is?

And just kind of introduce yourself and your company and what you can do folks.

Lisa Scholz: Okay, so I’m a private non-attorney mediator. I know a lot of people know attorneys that also do mediation. And this is kind of a completely different perspective.

I have a practice where I help people through with their Divorce process. They need to have their legal advice from somewhere else that doesn’t come from me.

But I work on the communication skills. I work on coming to an agreement that works best for their family.

And that’s the most important to me is that it fits what they need as a family especially if there’s kids involved.

Tim: So regarding kids and family just overall decision making mediation as opposed to litigation long term especially if kids are involved–

Lisa Scholz: Yes.

Tim: Is going to be beneficial because they’re getting a Divorce but they’re still going to see each other on custody exchanges.

Lisa Scholz: The relationship needs to stay intact.

Tim: Yes.

Lisa Scholz: I mean you may not like your partner, you may not get along well enough to live together anymore but when you have children involved that relationship needs to be where you have those communication skills.

And you were able to salvage whatever relationship you had left so that your children are not the collateral damage.

Tim: Right. So tell us a little bit more about you specifically and your background.

Lisa Scholz: Okay.

Tim: Regarding how did you get into mediation. How does this come about?

Lisa Scholz: I went through Divorce as well several years ago. And was like most of the public that I’ve talked to, I didn’t know what mediation was.

I heard that I was supposed to go mediation before we had a hearing date. My ex-husband was not interested in participating in that.

That was something he wasn’t interested in. And I looked further into it. I asked a lot of questions.

I was getting ready to go back to school to get a Graduate Degree. And decided that was something I wanted to focus on.

It was Mediation in Complex Resolution. So I actually received my Masters in that specialty in Psychology.

So I come from a completely different perspective, a different background than attorney mediators do. I don’t have that litigation mindset.

I want a peaceful process. And it is completely in the hands of the parties of the clients.

This is their life which the decisions they make about their family should come from them and not from anyone else.

So more of a facilitator trying to ask those important questions that make them thinks about what’s the most important.

Court Facilitator vs. Court Mediator | Los Angeles Superior Court

Hi! This is Tim Blankenship, owner of divorce661.com. Today I want to talk to you about the difference between the court mediator and the court facilitator. These are two services that are free. If you consider paying your filing fee with the court, part of the services of the court is to be able to use the court facilitator and the court mediation services.

So here’s the difference.  The court mediator is an attorney who works for the court and a neutral third party and will assist you in helping you come to an agreement on certain issues. These issues generally relate to your child support, child custody and child visitation issues. .

Mediation is required if you go and you’ve filed a motion for child support, child custody, child visitation or some type of request for order regarding those issues, or you can make an appointment with them at any time when you need assistance coming up with a parenting plan.

The court facilitator on the other hand is another attorney working for the court and is another neutral party that doesn’t represent either one of you and their job is to help you come up with a solution for spousal support, that’s their sole function.

So if you have questions regarding spousal support, how much you have to pay and what the law says as much as spousal support is concerned, you can go work with the court’s facilitator to help come up with a figures for as how much is spousal support,  if any is going to be paid.

Both these services are provided by the court. They are not mandatory that you come up with an agreement. They’re not going to force you into an agreement.

They’re there to educate you and hopefully help you come to an agreement regarding child support, child visitation and overall parenting plan.

With the mediation service and with the facilitator to help you come up with help as far as spousal support is concern.

Different Types Of Divorce Mediators | Santa Clarita Divorce

We are a company that specializes in divorce document preparation in Santa Clarita.  We are not mediators, but often work with divorce mediators in Santa Clarita and wanted to discuss these different types of mediators.

There are different types of divorce mediators out there and we wanted to share with you this information so you can make the best choice and understand what your money is paying for.

First off, let’s talk about divorce mediators that are actual attorneys.  These types of divorce mediators work as a neutral third party.  This means that they do not represent either one of the spouses, rather they work to assist both of you.

The divorce mediators will meet with you together, explain the law as it relates to your case so both of you can make informed decisions.  They will explain what a judge may or may not order if you go court as well.

Divorce mediators who are attorneys are able to draft a Marital Settlement Agreement or MSA for short.  This marital settlement agreement can be used to submit to the court and has all the legal language required in a divorce judgment.

This marital settlement agreement is then attached to the judgment forms and submitted to the court.

You are going to pay more for these types of divorce mediators because they are attorneys.  However, at the end of the divorce mediation process, you will have a completed MSA ready for submission to the courts.

On the other hand, you have divorce mediators that are not attorneys.  These non attorney mediators cannot provide you with a legal document used for court. Non attorney mediators cannot practice law and therefor cannot draft the MSA which is necessary to submit to the court.  So at the end of your mediation in these cases, you have little more than a written document which will later need to be translated to a marital settlement agreement.

Non attorney mediators are much less in cost than attorney mediators.  Essentially, this is due to the final product you receive.

Depending on what you are trying to achieve in your divorce mediation will dictate which type of divorce mediator you should chose.
