Today, we’re talking Request For Orders, previously known as Order To Show Cost.

So Request For Order, that’s something you would use, it’s a tool you’d use or document rather court document that you’d use if you want to file a motion with the court to request some type of temporary orders.

Now we’ve been filing a ton of Request For Order Motions lately and I just want the folks know in Van Nuys area if you’re going through a Divorce in Van Nuys or considering filing for Divorce and it needs some type of temporary order we can help you prepare your Request For Order.

Now when you’re going through a Divorce more people don’t understand is once you file and serve and you’ve started going through that process there are no orders of the courts.

So there’s really nothing anyone has to do regarding the kids, alimony, child support. Without an order there’s nothing that anyone is you know obligated to do if you will.

So if everything is going well and everyone is doing what they should be doing and maintain this as growth financially and taking care of the kids there’s really no reason to file Request For Order.

However, when you need to get orders in place because you either want to protect yourself or maybe you’re not getting in cooperation with custody and visitation of your kids that’s something you can do through a Request For Order.

So this is a service we provide. And some examples would be if you’re not getting alimony when you’re going through a Divorce process you could use a Request For Order.

Also, for child support, child visitation and child custody just about anything you need temporary orders for you can request through a Request For Order with the courts.

The process is filling out through request for order form FL-300 followed by a declaration explaining to the court why the judge should make orders as you’re requesting.

Now your spouse having opportunity to respond and eventually go to a court date where you’ll speak your piece, your spouse will in kind do the same.

And the judge will then make an order based on what they feel as in the best interest of the parties.

I want to talk to you about our QDRO Prep Service. This is Qualified Domestic Relation Order QDRO Prep.

So what we’re talking about here is if you’re going through a Divorce or when you’re going through a Divorce and if you have a pension like a City pension, a County pension, maybe a 401K 403 (b) even some IRAs, when you’re going to divide those the chances are in most cases you’re going to need to do what’s called a QDRO, Qualified Domestic Relations Order to officially divide your pension your 401K 403 (b) etc.

So what’s happened the pension usually in the past is always required a QDRO.

Now many 401Ks or any pension type like type systems or pension systems are going to require you to do what’s called a QDRO.

We do offer that as a service. If you’ve used our Divorce Service in Van Nuys for you to complete your complete case, you know, we’re probably also doing your QDRO.

But if you’ve used attorney maybe you’ve done your own Divorce case or something like that and now you’ve realized you need to do a QDRO for your pension we can certainly help you.

Now QDRO again is basically is just a document that brings your pension into the Divorce case.

We’ll notify the court that there’s a pension and vice versa we’ll notify the person that there is a Divorce going on and then the QDRO can be prepared and that’s the service that we can take care of for you.

Now the benefit of using our service is we’re a lot more cost-effective. So if you’re using an attorney you’re going to look up towards $1500-$2,000 per QDRO.

This is a location where it’s a non profit organization that usually inside the courthouse somewhere there will be some folks that can assist you with your paperwork.

Today, I wanted to provide this video for folks who are considering processing their own Divorce kind of talk to you about some of the uphill battles you’re going to face.

Explain a bit of the process and then kind of give you an alternative to using the San Fernando Divorce Self Help Center.

So family law is one of those original laws where you can complete your own case. If you’re going through an amicable case you can do all the paperwork on your own.

You can get the forms online. You can pay for online services. You can even go down to the San Fernando Divorce Court Self Help Center and get free assistance.

Now all of that is fine and well and it sounds great “Hey, you can get through your Divorce for free.”

But it doesn’t come without a bit of a complication. And I want to explain that to you so you know what you’re getting yourself into.

The Divorce Self Help Center in the San Fernando Courthouse is extremely busy. They usually can usually help between 10 and 15 people per day.

And you’re not going to get your entire Divorce case done in a day. You’re going to have to do this in steps.

So what happens is folks that are working routinely will miss several days of work going down to the courthouse, dealing with parking issues, dealing with waiting in long lines and then sometimes going down there and not even being assisted on that particular day.

So it could be quite lengthy and quite frustrating for folks.

Now I know this because number one years ago before I even got into this industry, I worked at the Self Help Centers as a volunteer.

Today, we’re talking about QDRO which is Qualified Domestic Relation Orders. And QDRO for folks who are going through Divorce or had their Divorce case processed at the San Fernando Courthouse.

So San Fernando QDRO is the name of this video.

And if you have a pension and you’re going through a Divorce or you’re going to get a Divorce or perhaps you’re using our service for your Divorce, if you have property and in that property is a pension 401K 403 (b), City County or State pension something like that in most cases if you’re going to divide that property, so, if you and your spouse are going to split that assets it needs to redone by what’s called QDRO.

That’s Q-D-R-O again Qualified Domestic Relations Order. The reason why I bring this up is that this is a service that we provide.

It does not have to be done by an attorney. Most people will tell you, you need to find a QDRO attorney but it’s not the case.

We are as a Legal Document Firm we do handle QDRO. We handle Divorce cases of course because QDRO falls under the umbrella of family law.

We also handle the preparation of Qualified Domestic Relation Orders.

So whether you’re using an attorney or you’ve done your own Divorce or you use our service, once your case is complete or somewhere during the Divorce process if you’re going to divide that pension if that’s the determination you may.

You’re going to have to do that by QDRO in most cases. So what I recommend you to do is call your 401K and let them know you’re going through Divorce and ask them, “Do I need to divide this pension by QDRO?”

If they say yes, you can ask them for a QDRO package. It’ll be helpful. We will need that when we go to complete your QDRO.

If you didn’t get it we can ask them for ourselves. But if you happened to speak to them to confirm you do need to have a Qualified Domestic Relation Order for that asset, you can ask them for the QDRO package you will need that to get your QDRO prep.

So I just want to let the folks know who have used our service or otherwise we do QDRO Preparation Service anywhere in California.

If you need that service we do it for a much lower rate than attorneys do it. For the QDRO can range anywhere as high as $2,000 to have an attorney prepare your QDRO.

California Divorce |Trial Setting Conference Now Requires Court Reporter Fee

I want to start off by saying I handle a lot of Divorce cases 40-50 Divorce cases every month. And these are Divorce cases where we handle the entire process from start to finish.

And because we file so many Divorce cases we’re usually the first to find out some new rule or new procedure with the Divorce courts.

And today we found out a new rule that just came up with. It’s not necessarily new. It’s just something that there’s been a change.

So one of the new rule that happened recently in Los Angeles County I’m sure it’s going to spread throughout the remaining counties in California, is the court you’re asking that parties who appear at hearings that they request, so, motions requested for order, order to show cost type hearings are they’re going to ask that you pay a court reporter fee.

This is the fee that the court uses to pay because court reporters are not part of the court system. They kind of run their own business in a way.

So now when you file a motion or ask for hearing you’re going to have to pay in addition to any court fees. Right now it’s a $30 court reporter fee.

Now this was a common practice recently for request for orders and things in that nature. The change now is for trial setting conferences.

So if your case is not moving forward usually what is recommended is you file a trial setting conference so it gets the court involved and they’ll start setting a series of hearings moving you towards a trial.

First hopefully you can come to an agreement at some point but if not you’ll end up a trial. But the trial setting conference was a routine request and it did not require a fee.

It was a no fee filing. And you need to appear in your hearing and it was part of your overall court filing fee.

Now and this was just today, we’re notified by a client who’s representing himself that because we set a trial setting conference request they received a notice and the mail says by the way when you appear you’ll be required to pay a $30 court reporter fee for the hearing.

So that’s the update today. If you file a trial setting conference, there is going to be a $30 fee now because the court houses and the court departments within the courthouses all either don’t pick up on the new policies right away or they handle there differently.

If you don’t asked to pay then you got lucky but you can anticipate that. We’re going to see this is a common practice across the courts in California asking for court reporter fee for trial setting conferences.

We don’t see really complex cases where parties are fighting or they’re going to court or people hiding assets you know that really nasty Divorce you hear on TV or heard on Divorce Court.

That’s not the type of Divorce cases we handle. But we do handle a large volume of amicable style, a friendly divorce cases for the most part because you’re going through a Divorce.

But today I got a phone call and it just bugged me. A lady called. She had gone through or in fact she had done a legal separation with her spouse.

She was a stay at home mom for years. They were married for 30 plus years. And she said, “I filled out some paperwork. My husband did file for legal separation. I signed some documents and I am just wondering you know if it’s completed or what the status of the case is.”

So the short story is it appears from this conversation with the spouse that she had no idea that in going through the legal separation process that they had distributed all the assets and debts.

And she had no idea what was given to her, what she signed or not signed.

And so when we’re going through this she already started crying not realizing she had no idea what she had signed as far as assets and debts as part of the distribution, custody and visitation.

All she knows is she has trusted her spouse to do the right thing. And he may have but she doesn’t know what she signed.

She doesn’t remember asking for any assets and debts or what she has provided or what she’s getting in this legal separation which has no different than Divorce, all the assets and debts need to be divided.

And the issue here was the husband had significant assets per what she said. We didn’t go over any detail but there were significant assets, significant income.

And he had done always he took care of the loans throughout the marriage, he took care of paying the bills, he took care of all the finances and she was a stay at home mom and all was well and that worked for them.

But if that’s the case what happened now? She was crying by the time we were done because I discussed with her the fact that whether you signed or not your case is done, your assets have been divided and she had no idea what she was given in the separation or divorce.

And all I could say was either it sounds like your spouse kind of duped you and got you to sign some documents that may have been your best interest especially if when you weren’t told what they were.

So all I could tell her is you know you need to go to an attorney.

Take your judgment and have him look at it and see what happened because you may have to set aside and this could be the beginning of your long drawn out process.

The conclusion with this is, if your spouse that was not involved in the finances, not familiar with what is going on financial with the household and you’re going through a Divorce like I told this lady, “You need to wake up. This is not a time to trust your spouse.”

Of course, I say that knowing that we handle amicable divorce cases but in cases where your spouse is trying to take advantage of you, you’re going to have to pay attention and you’ll get representation or get assistance with your case, because this lady is legally separated and had no idea that her property was divided, that there are custody orders in place because she just trusted her spouse, signed where he said to sign.

And she might be okay, the chances are this is going to be something where she doesn’t realized she really messed herself up after this long term marriage.

I just want to get that off my chest. Nothing too information there or informative like I normally do with forms and so forth but I just want to share that with folks.
