167: Can You Sell Your Home At A Later Date During Divorce

In this episode, we will talk about if you can sell your home at a later date during your divorce in California.

I skipped one of our four. I missed see the slides. Sell at a later date.

So if I had four options. You had another about the rental. That was good.

Sell, refinance, keep existing mortgage, sell at later date or rent it out. We have people doing that.

But selling at a later date, we have folks that have either a primary residence or a vacation home or a rental of some sort, that they’re making rents on. Okay, let’s say, it’s a rental or any of those types of homes.

And either the values not there or they want to hopefully go up in value so they can sell.  So we have a specific circumstance with a client, vacation house, they make rent.

It’s like an Aspen or something like that Big Bear I don’t know. And they rented out and they make money up but they sold, there’s not enough value. They overpaid for it back when real estate is blooming.

So they want to wait several years before they sell it. That was the agreement.

In this episode, we will talk about how to value your home during divorce in California.

So they’re going to sell. Now they have to come to an agreement on what’s it worth.

We had clients in here couple weeks ago. They had everything settled. The house is actually paid off in cash. So they are in good shape financially.

The issue was what is house worth? So if they’re going to divide it evenly coming to a firm like evaluator.

In this case one party thought the house was worth $50,000 more than the other party.

And they’re looking at comparisons and all that. But what’s the best way to come to an idea? Do they get independent appraisers?

Do they get independent agents to do like of a compared market analysis? This particular client I said, ‘Look, you’re talking about $50,000 whole. It’s really about $25,000 to you, if they’re dividing which they’re like ‘Okay, that’s not that bad.’

If they can meet in the middle, I mean there are lots of options.

Divorce Mediation West Hills CA | West Hills Divorce

Divorce Mediation West Hills CA | West Hills Divorce

Today, we’re talking to the folks in West Hills. Now I want to talk to you about Divorce Mediation.

A lot of folks when they called us they have questions about Mediation.

I just want to clarify what Divorce Mediation is compared to what it is that we do because what we’re finding in most cases the folks looking for Divorce Mediation Services don’t really need Mediation.

So first let me tell you about what we do.

As a Full Service Divorce Document Preparation Firm we will complete all the paperwork, fill out all the forms, deal with the court direct for you, handle all the financial disclosures and put together your agreements including your marital settlement agreement otherwise known as the judgment.

We have all the court software and forms that the courts and attorneys have, so the DissoMaster Software.

Everything it’s going to take to get you through your Divorce, we have.

Now when you use our service it’s going to be up to you guys to come to all the decisions, custody, visitation, child support, spousal support.

Of course, we can provide assistance with that and some guidance.

Where Mediation comes in place is where you need help with decisions.

Maybe you are having trouble communicating with your spouse and you just need someone to sit in the room with you and help you figure out how you can communicate and get passed the couple obstacles.

Or maybe you need a higher level of assistance with communication and maybe you need an attorney in the room or maybe two attorneys to sit there and help guide you guys through the decision making process.

So what we generally we’ll recommend is that you start your Divorce case even if you think you need Mediation.

And let’s get you as far as we can get and then if you do have difficulty with coming to an agreement we can always refer you out to Mediation and get your one or several issues handled.

And once you’re done you just simply come back to us so we can incorporate those agreements into your Divorce.

So that’s a basic understanding of Divorce Mediation. And I’ve done probably 20 or 30 videos specifically about just Mediation.

So you can look those up as well on our YouTube Channel or on our website at Divorce661.com.

165: Should You Keep Existing Mortgage And Let Spouse Stay After Divorce

In this episode, we will talk about is you should Keep your existing mortgage and let spouse stay after divorce.

Some people are misadvising their clients or in Real Estate and say, well, you can pull the spouse off with the quick claim deed. But that doesn’t fix it with the loan.

So the cleanest break you can ever had, would be is just get rid of it, sell it. Or refinance it completely out.

If one of the party is capable and one of them wants to stay in the house, absolutely!

I have to say we’ve had a lot of clients just of financial reasons quick claim off the house and just take the risk of being on the loan.

California Support Payment Tax Mistakes | California Divorce

California Support Payment Tax Mistakes | California Divorce

Today, we’re answering the question about spousal support, child support and family support and some of the common mistakes made by tax payers.

Now we’re getting this information right from the State of California Franchise Tax Board.

And we’ve already done a couple video where we discussed family support, child support and spousal support separately.

But I wanted to read to you what the State of California Franchise Tax Board says some people are making as far as mistakes related to support with that family support, child support and spousal support.

So it says many tax payors mistakenly consider all payments made to their former spouses as deductible alimony payments.

For example, tax payers frequently include none deductible child support payments as alimony deductions.

On the other hand many alimony recipients do not consider the payments from their former spouses as taxable income and failed to report them.

Some recipients make the common mistake of not reporting income designed as Family Support by the Divorce Decree.

This type of support is considered alimony income in most cases.

Now so basically what that means is and we can kind of recap the three previous videos child support is not tax deductible according to the Franchise Tax Board.

Spousal support is tax deductible and thus reportable income to the spouse receiving income.

So that’s essentially the three mistakes that folks are making. And you could see that, that would have it on your taxes if you are not deducting your spousal support payment you’re making, if you’re not reporting the spousal support payments you are receiving or you’re deducting or claiming the income of child support which you shouldn’t do.

So I hope that answers the question of the common mistakes made by tax payers regarding to support payments in California.

If you have any questions you can feel free to give me a call. We do handle divorce cases throughout California.

We specialize only in divorce. Our number here is 661-281-0266.

If you need modified support payments if you have questions about support feel free to call I’ll be happy to provide a free phone consultation for you.

The number is on your screen and we’ll talk to you soon.
