How To File An Order After Hearing | Santa Clarita Divorce

You went to divorce court, spoke to the Judge during a hearing and the Judge made orders that you requested.  That’s great, right?  Not so fast, you still have to prepare an Order After Hearing or OAH.

This article is a follow up to an article we wrote about representing yourself during a hearing and what you can expect.  This article is going to explain what you have to do after the hearing in order to have your judgment enforced.

Once the Judge makes orders, you have to get a copy of the Minute Order.  The Minute Order is what the clerk in the courtroom prepares and is a written summary of the Judges orders.  You can get a copy of the Minute Order a few days after your hearing.  You will then use the Minute Order to prepare your Order After Hearing.

What is an Order After Hearing?  It is a form you will use to document what the Judge has ordered.  You will prepare the Order After Hearing  which then needs to be mailed to your spouse who is to sign the Order After Hearing agreeing to the language of the Order.

But what happens if they refuse to sign it?  In that case, you have to wait 10 days for them to return the signed Order After Hearing.  After that, you can file the OAH along with a Declaration Regarding Execution of Order After Hearing.

When you mail the Order After Hearing to your spouse for their signature, you have to include a letter which indicates that they have 10 days to respond.

It is quite a process to get an order signed by the court.  By this time you have waited about 2 months to get your hearing, then you have to get the Minute Order, complete the Order After Hearing, wait 10 days, then draft a Declaration Regarding Execution of Order After Hearing, then wait for the Judge to sign and return that.

So here is our recommendation.  If you are going to represent yourself in court or at a hearing, have us prepare your motion.  We will take care of everything from filing and serving to completing the Order After Hearing so you don’t have to worry about all the requirements as discussed here.

Did you know that when you move while going through the divorce process you need to file a change of address?  Yep, there is a special form just for that.

I find that many of my clients are not aware of this.  In fact, when I learn that they have started their divorce on their own several years ago or they filed in a court that no longer appears to be the correct court, I make sure to ask if they have moved since they filed the initial divorce paperwork.

It is not likely that the court is going to mail you anything.  It is more about providing this information to the other party.  If you move and don’t tell your spouse you moved and they need to serve something on you, then they are going to have a difficult time.

One time the court will mail something to you is when you submit the final divorce judgment.  They will need to mail you a conformed copy that the judge signed.  So if you want to make sure you get a copy of your divorce, you will want to make sure the court has your current address.

The form you use to change your address when going through a divorce is form MC-040 called, Notice of Change Of Address or Other Contact Information.  As you can see by the description you can use this form not only to change your address, but to update phone numbers or any other type of information that has changed.

Make sure when you fill out this form that you also file it and serve the change of address.  If you fail to complete the 2nd page which is the proof of service, the court will reject your change of address.  The best way to do this is to complete the entire form, including the proof of service.  Then make a copy and file the original with the court.

I hope it does not seem to tacky, but it was something that came up today when discussing the costs of getting divorced.

I was talking to a new client who said they wanted to get divorced, but they just needed to wait for their tax return so they would have the money.

It got me thinking about what I do as a business and why I have this divorce legal document preparation service to begin with.

I never thought we would be in the business of providing affordable divorce document preparation.  In fact, I was working with a divorce law firm here in Santa Clarita getting experience in family law while I went to law school.

How To Get A Continuance For A Divorce Hearing | Santa Clarita

We have been talking a lot about filing motions this week and have helped several clients set court dates for hearings.  But what do you have to do in order to get a continuance for a hearing you have coming up.

Getting a continuance on a hearing for divorce case such as appearing on a motion that was filed can be quite simple, and in other cases can be a total pain.  It really depends on the cooperation from the other party.

Lets discuss the easy way.  The easiest way to get a continuance is to ask the other party if they would be agreeable to continue the matter.  It could be for a variety of reasons such as wanting to try and work it out before going to court or because you are going to be out of town, etc.

If the other party agrees to continue the matter, all you need to do is call the clerk in the department the divorce case is in.  Make sure you both call in together on a conference call.  The clerk will want to make sure that you both are agreeing the the continuance.

It is a good idea to have your calendar out so you know your availability.  The clerk will look for the next available dates to continue your matter to.  Don’t be surprised if it is several months away.  Once you, your spouse and the clerk agree on a date, you are done.  You will most likely have to file a notice of continuance with the court and pay a small fee.

Now, lets discuss a situation where the other party does not agree or does not respond to your request for a continuance.

This is a situation we just had to help a client through.  Husband filed a motion.  When wife was served she realized that the date of the hearing was when she would be out of town, several states away.  She asked Husband for a continuance and he has not responded.

Because the date of the hearing was fast approaching and because she could not cancel her trip, the only thing she could do is petition the court for a continuance.

So what we did is prepared an Ex-Parte Motion requesting the court to grant a continuance.  This is the only way to get in front of a judge so they can make a ruling on it.

It is a huge waste of time and money, but in this case, was the only way she was going to have a chance to ask the judge for a continuance.
