There is no easy way to tell your spouse you want a divorce. For those who have already discussed it, it usually comes about as they are having an argument on too many occasions and someone says maybe we should just get a divorce.

If you are thinking about getting divorced, I think in most cases and is the experience of our clients, that the other spouse should be at least somewhat aware that you want to get a divorce or that things are bad enough that you don’t want to be married anymore.

I say this with a grain of salt thought, because I know that having done this for so long that the majority of people filing for divorce are woman and many of the men say they had no idea that things were so bad that their wife wanted a divorce.

I hear often from women that things were just in a rut and the men just went along with their daily routine as if everything was fine while the wife wanted things to change. One day I will figure out what this is all about.

If you have not told your spouse you want to get a divorce I would say that there is probably no right time, but that sooner is probably better than later. You don’t want to get to a point where you despise the them because you held off from telling them for so long.

This goes for both parties. Both of you need to give more than you take. By doing so this will create an environment where it seems you are both willing to bend a bit on what you want out of the divorce.

I am always telling my clients that the alternative to not being flexible or not wanting to compromise is to hire attorneys and spend a ton of money on that.

Here is an example of spending money you shouldn’t. Let’s say that you guys are stuck over some piece of property or asset worth $5,000. Let’s say that each of you want to keep it and neither one of you are willing to compromise at all. The alternative is to hire an attorney so you can fight over the issue of who it belongs to.

So you hire a an attorney and lets say they charge you the going rate of $5,000 retainer. And then your spouse hires and attorney at a $5,000 retainer. How much sense does it make to spend the same amount of money you are going to give to an attorney to fight over this asset. I have seen it done and it make no sense.

It is probably going to feel like you are compromising way more than you want to when going through a divorce. Just know that it feels exactly the same way to your spouse. Each of you are going to feel like you are compromising more than you want if you expect to go through a friendly type diovrce.

I want to talk to you about why you should not use a Marital Settlement Agreement that you can find on the internet. First of all, the marital settlement agreements off the internet cannot be vetted. Meaning, you have no idea who put that marital settlement agreement on the internet.

The second problem is that these marital settlement agreements you find online are not legitimate and do not meet the criteria for being an actual marital settlement agreement. This is because they don’t have the necessary legal language that a properly prepared marital settlement agreement should have to comply with the rules and legalese necessary for a California divorce marital settlement agreement.

Request For Order Time Frames For Serving : Valencia Divorce

Filing and serving Request For Orders or RFO’s can be confusing.  I have discussed in the past, but since I have just finished up another Request For Order for a client, I thought it was a good time to go over the timeframes for serving them again.

We provide 2 options for preparing your Request For Order:

1. Full Service – We will draft, file and serve your Request For Order

2. Do-it-yourself – We have a online video tutorial with all form and example declarations

The most important thing you have to remember about serving timeframes of Request For Orders is that everything is hinged off of the court date you were given by the court.

There are 2 sets of timeframes you can use, whether you are serving it by mail or serving it by personal service. Please note that we are not discussing when you have to serve by personal service or by mail in this article, but to be safe, serve by personal service when in doubt.

Here is the way you figure out the date you have to serve your Request For Order.

Let’s say the court date is on June 30th. Everything will be working backwards of that date, so it will look like this.

17 Court days to serve the Request For Order by personal service
Plus 5 Calendar days if you are serving by mail. Again, there are restrictions on serving by mail so make sure you can serve by mail in your case.

So you will take June 30th and count backwards 17 court days. This means you need to skip over the weekends and any court holidays and make sure you don’t count them. The day you land on, will be the last day to personally serve your Request For Order. If we are using a 2016 calendar, the last day to serve the Request For Order would be June 7th. Again, make sure to check for holidays and to skip the weekends.

Keep in mind that you don’t have to wait until the last minute to serve your Request For Order, you can serve the Request For Order as soon as you have it filed and have a court date. Some people wait until the last minute to serve the Request For Order to be mean and give a shorter period of time for the other party to Respond, but that is up to you.

Make sure that once you serve the Request For Order that you file the proof of service with the court.

Recommitting To Providing Valuable Content & Marketing Efforts

Today I took a few hours to myself.  With all the hustle of owning a business one can get caught up in the day to day of business and life and forget to take a step back and a moment to see what is going on.

Today was that day.  I did not plan for it, however it just turned out that way.  I woke up, realized I had no clients physically coming into the office (at least to see me) and decided to take some time to check in with me.

I started the day walking my dog for an hour along a beautiful path behind my house in North Park.  You would think taking a day for “me” would mean being with myself and not working or focusing on business, but it guess it is just in my DNA at this point.

I am referring to the fact that while I was walking, I decided to record a video.  I was listening to a podcast and recalling a conversation I had with someone in the “divorce space” who said they had watched a video of me where I was recording in my vehicle.  He said that the thought I must not be doing well, business wise, if i have been reduced to having to record while in my car as opposed to in my office.

So I recorded a short 2 minute video on my walk, on my phone to tell people about this thought process someone had about my business.

And when I explained to this person that I had intentionally recorded these videos in my car, he was a little surprised.  I told him that I was not making videos in my car because I didn’t have an office, rather I intentionally recorded these in my care for several reasons.

The first reason is to make good use of my time.  I find myself frequently in line at Starbucks or other places and have a few minutes of staring at the car in front of me.  I take those moments to record my videos or podcasts.  Sorry, I am just efficient in that way.

Second, I want to give my viewers a little bit of change of scenery when they are watching my videos. At this point I have recorded over 800 videos.  Mostly these videos are from my office.  I had a trusted friend tell me one day that he thought it would be good to see me shooting videos in different locations and situations.  The car just became one of those.

So I going back to my walk, I decided to make a video on just this. Explaining to anyone else that may have though I was shooting video in my car because I was office-less, to ensure them that this was for their enjoyment and to just mix things up a bit.

In any event, this day of being with “me” helped me to realize that I needed to recommit to providing more videos and content. Now, you may be saying, “Tim, you do a video nearly every day and have over 800 videos”. Yes, that is true, but I have really been holding back. Meaning I have enough to say to provide 5 videos a day. I used to do that, but I find myself getting busy with doing the job that sometimes that takes away from promoting my business and providing helpful information online.

The other thing I am doing today is reading.  I wish I had more time to read.  I am not a casual reader, however.  I am usually reading business books on marketing and how to grow a business. Today, I received in the mail (yes, I like to feel paper still) my new book, #AskGaryVee.  Yes, that is the name of it.  You either know who this is or don’t, but I am not going to spend the time explaining other to say it is someone you should be listening to if you own a business and are in a space where your life is about marketing.

It is books like these that reaffirm what I am doing and what I need to be doing.  What I have done in the past to have a successful business and what I need to do forging ahead.

So what can you expect? Much more “hustle” and getting the word out about my business and providing valuable free information about divorce and the business I am in.

Heading To Seattle Washington

It is just before 6 a.m. on a somewhat rainy Saturday morning.  I am sitting in the Bob Hope Burbank Airport Gate B-5 heading to Seattle, WA.  Why? Because my wife who works as a consultant was supposed to come back yesterday, but ended up having to stay another week.

Because she had to be back at 8 a.m. on Monday and due to last minute flight arrangements, the only flight back to Seattle was on Sunday morning at 7 a.m. which meant she would have only been home one day.

So, instead of having her come all the back, I decided I would fly out to see her and visit Seattle.  A little impromptu get away for the weekend.

Our weekends are not normally very exciting.  I usually just end up going to the office to catch up on work most of Saturday. Sunday is the normal household duties and getting ready for the week.

So it should be a fun weekend.  I told my wife it was her job to make reservations or at least figure out what we are going to do while I there.

I booked my tickets on Thursday so the prices of flight tickets were pretty expensive.  I think the airlines have this all figures out to get you on price.  The cost to leave at 7 a.m. on Saturday morning was twice the cost of leaving at 11 a.m.  They know you want to get there for the weekend. Then there was the Friday option.  The morning was cheap and the evening was twice the cost. Again, they knew people were leaving and trying to get out of town.

Well, getting ready to board and will see you in Seattle.

 

Santa Clarita Business Podcast : A New Venture w/ SCV Local

I have been very fortunate to have started a divorce company in Valencia from the ground up.  Literally started on a shoe-string budget out of my loft years ago.  I wasn’t fortunate because of dump luck, rather out of sheer determination to learn how to market my business properly.

But it was difficult.  I had to learn how to build a website, blog, podcast, create videos and learn everything about marketing so I could grow my business.

These are difficulties most new business’s will face.

But why does it seem we, as business owners, are all alone in trying to figure out how to have a successful business?  I know I felt that way.

So to try to help out local business’s in Santa Clarita I decided to start a little project.  Well, it started off as a little project, I just didn’t realize how much time it would take.  It is like running a whole new business.

Anyways, the idea was to create the first Santa Clarita Business Podcast dedicated to interviews of local Santa Clarita businesses.  The idea was to give them exposure in an entirely different way.

Here you will find interviews of locally owned and operated Santa Clarita business’s and the interviews will be hosted not only on the website, but through it’s own podcast on iTunes.  These will be long form podcast interviews that will go beyond just talking about the business, but will talk about the person behind the business.

I personally think it will be very interesting to learn about our local business owners.

1 Week Seems Like A Long Time – Day 8

I don’t know if it is because I am so much more productive due to having more energy or what, but this last 8 days have seems liked they took a long time.  Like it was a long week, but no in a negative way.

I got so much done this week.  Because I am sleeping better, I am sleeping less.  The quality it better.  So I am only sleeping about 6 hours a night.  And I feel better after 6 hours than I would after sleeping 8 or 9 hours before.

My day now typically starts at 6 a.m. and ends around 11 pm or midnight.  I try to go to sleep earlier and my body just isn’t interested.

Now I have been alcohol free for 8 days now. I was not a problem for me to stop, but just to break the bad habit.  Was not so much that I needed to drink as I just turned it into a habit and would drink everyday because I had nothing else to do.

The first real test of not drinking will be this Saturday night. We are going out to dinner with friends so will have to see if I have what it takes to not drink.  I just think I will see everyone else drinking and having a good time and not want to miss out.

It is my goal not to drink because I am feeling to good.  I don’t want to jeopardize what gains I have made in my health, even though it has been just one week.

Not much to report from Yesterday, I just did a leg and shoulder workout with my wife.  This morning I am going to the 8:30 training and it will be a weight day again.  That works for me.

Body Fat Testing With Jim Johnson @ Ignition Fitness – Day 6

So I walk into Ignition Fitness this morning a little early.  Jim, the owner of Ignition Fitness, had previously mentioned that he had a super fancy scale for determining body fat and all that good stuff.

So today I asked him if we could give the body fat machine a whirl.  So we did.

It was a pretty sophisticated machine in that, from what I understood, used electrical current to determine fat, water, and other factors.

Today I weighed in as 276 with 30% body fat.  Looking forward to losing some fat and gaining some muscle and dropping some weight in the meantime.
